This Privacy Policy (hereinafter referred to as “Policy”) is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011. This Policy is an “electronic record” as defined under the Information Technology Act, 2000 and the Rules thereunder. This Policy is generated by a computer system and does not require any physical or digital signatures. By using this Site/Mobile App/Platform, You expressly consent to our collection, use, disclosure, and retention of Your personal information as described in the Privacy Policy. This Privacy Policy is incorporated into and subject to the Terms of Use.
The web-application www.tootoo.in and the TooToo Mobile Application (“TooToo App”), jointly referred to as the “Platform”, are owned by Beverly Applications and Technologies LLP (“BAT”), a company incorporated under the Companies Act 1956 with registered office at A-37 Mayapuri Industrial Area, Phase-2, New Delhi – 110064, INDIA (hereinafter referred to as “BAT”.
The Privacy Policy below governs the use of and access to our Platform, www.tootoo.in, and the TooToo App (hereinafter collectively referred to as “Platform”). In this Policy ‘You’ and ‘Your’ refers to the user of the Platform. This Policy becomes applicable to You as soon as You visit our Platform or download our mobile application.
BAT may at any time modify this Policy, delete some of its clauses or add new ones. Any modification will be made unilaterally by BAT and it is your responsibility to keep checking the BAT platform for any changes to the Policy. You will be deemed to have accepted the modification in case you continue to use the Platform after the issuance of the new Policy.
In case You are not in agreement with any modified clauses, You must close/delete Your account by contacting us at info@tootoo.in or by deleting your account yourself through this Delete Account Link. If You do not manifest Your refusal of the modification by closing Your account, You shall be deemed to have accepted it.
COLLECTION AND USE OF INFORMATION
We collect and store Your personal information like Your name, email address, mobile phone number, postal address and pin code when You register on our Platform, shopping and product preferences, and information about the pages on the site You visit/access, the links You click on the site, the number of times You access the page and any such browsing information. This information allows BAT to better understand Your preferences and to effectively manage the load on the servers, so as to improve the services and the use of BAT platforms.
Your credit card information is collected when You make a purchase.
BAT receives and saves information on Your IP address, geo-location, transaction history, and date and time of session on our Platform to analyse user behaviour and prepare aggregated reports.
When You access the BAT platforms, BAT may collect and store information related to the connection on Your device (including its identification number) and geolocation in order to be able to provide the services.
BAT also uses Your personal information so that we can (a) respond to Your requests and queries (b) send reminders and updates by email, calls, mobile messages (SMS) or WhatsApp (c) detect and prevent fraud and abuse of the Platform and to prevent fraudulent activity (d) verify Your financial or payment information (e) deliver and provide the products and services requested by You (f) administer the Platform (g) gather analytical data about Your preferences and interests to provide better service (h) comply with applicable laws, regulations and rules, and requests of relevant regulatory and law enforcement and /or other government agencies (i) enforce our Terms of Use.
You authorize and expressly consent BAT to share your personal information with third parties including but not limited to the BAT’s agents, service providers, as and when necessary.
BAT retains Your personal information until it is necessary to fulfil the purpose(s) for which it was collected, our business purposes and/or to comply with the applicable laws, and Your consent to such purpose(s) remains valid even after termination of our relationship with You.
You agree that the registration of Your account shall be construed as Your permission to be automatically opted-in (Opt-In) to receive promotional communication from BAT from time to time through calls, SMS, WhatsApp or Email. You can opt-out of this at any time by contacting our customer service representative.
COOKIES
A “Cookie” is a small piece of information stored by a web server on a web browser so it can be read back later from the browser. These are important to store Your preferences and track Your trends in order to enhance Your experience and enable the Platform to provide improved services to You. Most web browsers automatically allow cookies to be stored on the computer’s hard drive, but You can change Your browser settings so that it does not accept the cookies.
BAT sends a "session cookie" to the computer used when You connect to Your BAT account by entering and verifying Your cell phone number. These cookies allow BAT to identify You when You visit several pages of the site during the same session, so that You do not have to enter Your password several times. As soon as You log out or close the browser, these session cookies expire and no longer have any effect.
BAT may also collect information relating to the Your computer and other access equipment in order to limit the risks and for the purposes of combating fraud.
SHARING OF INFORMATION
We do not sell Your personal information to third parties.
However, we may share personal information with our affiliates, partners and other corporate entities, who may contact You as a result of such sharing unless You expressly opt-out.
The Platform may link to other the websites or applications of third parties who may collect personal information about you; you may be directed to other websites or applications that are operated and controlled by third parties that we do not control. The Company is not responsible for the privacy practices or the content of those linked websites or applications of the third parties and You are requested to carefully read the other websites or in-apps privacy policy when visiting such websites. This Privacy Policy does not cover the information You choose to provide to or that is collected by any third parties as mentioned above. We recommend that You reach out to such parties and read their respective privacy policies.
BAT will not sell or rent Your personal information to third parties for advertising purposes without Your explicit consent, and will only disclose this information in specific cases and for the purposes described in the Terms of Use and Privacy Policy. You, the USER, accept and instruct BAT to:
- Disclose information, including without limitation, personal contact information and the content of communications to the police, law enforcement agencies, relevant governmental, intergovernmental or supranational entities, agencies (other than tax authorities), agencies or competent regulatory or self-regulatory authorities or organizations or to any third party with which BAT believes it should cooperate in the context of investigations relating to fraud or other types of illegal or potentially illegal activities or to conduct investigations relating to violations of our Terms of Service. If false or erroneous information is provided to BAT and the fraud is proven, BAT will communicate all necessary details to fraud prevention bodies. Consequently, public authorities will be able to access and use this information. Other organizations and BAT may also access this information and use it for fraud prevention purposes.
- Reveal information in response to the demands of legal, civil or criminal process.
- Disclose information to BAT Partners. The disclosure of this information is only intended to better serve Your experience.
- As noted above, information includes: name, address, email address, phone number, IP address, account preferences, identity information, collected as part of registration and correspondence between BAT and You.
- Disclose information to the agent or legal representative of the USER (for example, the holder of a power of attorney or an appointed guardian).
- Disclose aggregated statistical data with BAT business partners, third party websites or applications, or for public relations purposes.
We and our affiliates may share some or all of Your personal information with another business entity should we (or our assets) plan to merge with or get acquired by that business entity, or in case of re-organization, merger, restructuring or business. In such a case the new business entity will be required to follow the Privacy Policy and the terms therein.
We may disclose Your personal information when required to do so by law, or may disclose such information in response to subpoenas, court orders, or other legal process. BAT may disclose Your personal information to law enforcement officers, third party rights owners, or others if in its opinion it feels reasonably necessary to enforce the Platform’s Terms of Use or Privacy Policy.
OPT-OUT
We send You marketing and promotional emails, calls, SMS messages and WhatsApp messages from time to time. You may opt-out of receiving such communications from us by sending an email to our customer service at info@tootoo.in
DELETION OF ACCOUNT
You can delete your account anytime by through the TooToo website (https://tootoo.in/delete_account). Upon Your deleting your account all your account details shall be removed, except for the ones required for security and safeguard against frauds. You may note that upon deletion, the wallet points collected by you shall be lost and un-recoverable.
We may retain the history of your activities, transactions and account on our Platform required for due diligence, taxation and regulatory compliances.
SECURITY
BAT takes standard measures to protect against unauthorized and illegal interception of Your personal information. However, the Internet data transmission is not always secure, and we cannot warrant or guarantee the complete security of Your personal information. You are advised not to share Your personal information and passwords with anyone. In case You suspect any unauthorized access to Your information, it is Your responsibility to contact BAT immediately. You may be advised that BAT personnel will never ask You to divulge Your personal information in written or electronic communications or over the phone. It is Your responsibility to sign out of Your account once You have availed the services through the Platform.
ACCEPTANCE OF THESE TERMS
In case You are not in agreement with any of the terms of this Privacy Policy, please do not provide us with any of Your personal information and do not use the Platform. By using the Platform and/or providing Your information, You consent to the collection and use of the information You disclose on the Platform in accordance with this Privacy Policy.
BAT operates internationally and many of our computer systems are based globally. You agree and acknowledge that the information collected through the Platform could be stored and processed in any country across the world. BAT may use trusted third parties for this purpose who may store and process the information provided by You.

LIMITATION OF LIABILITY
You agree and acknowledge that You have unequivocally consented to the terms of this Privacy Policy and managing of any and all of the data shared by You by the Company in relation to availing the Services. You also agree and acknowledge that the Company has no liability whatsoever in relation to this Privacy Policy and You shall not initiate any legal proceedings against the Company and any person related thereto with respect to the Policy.
The total liability of BAT, if any, that is established and ordered by a court of competent jurisdiction pursuant to a claim, shall in no event extend beyond refund of the money charged from a user for the transaction value for which the claim has been filed, and this also shall only made pursuant to an order under which such liability has arisen and established.
Under no circumstances may BAT nor any third party be held liable to You, the USER, for consequential, incidental, special, exemplary, punitive or indirect damages, including loss of profit, business, data, business interruption, commercial losses and damages resulting from the inaccuracy or disruption of information, delays or inaccessibility to the service, resulting from or relating to the site or any type of content, even if BAT or a third party has been informed of the possibility of such loss or damage. If this limitation or exclusion of liability mentioned above should be considered unenforceable for any reason, BAT's liability for all types of damages will be limited to a maximum of refund of the money charged from a user for the transaction value for which the claim/damages has been filed.
APPLICABLE LAW
The terms and conditions of this Privacy Policy shall be governed by Indian Laws and the courts of New Delhi shall have exclusive jurisdiction to resolve any disputes.
